Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Kindr application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. These Terms constitute a legally binding agreement between you and 12 Tables Holdings ("we", "us", "our").

2. Service Description

Kindr is an AI-powered family organiser designed to help parents manage school events and family schedules. The App allows you to upload school documents for AI-powered event extraction, manage a shared family calendar, receive smart reminders, and synchronise events with external calendar services.

3. Account Registration

• You must be at least 18 years of age to create an account.
• You may only create one account per person.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration and keep it up to date.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload content that is offensive, harmful, defamatory, or infringes on the rights of others.
• Attempt to scrape, reverse-engineer, or extract data from the App by automated means.
• Interfere with or disrupt the App's infrastructure, security features, or other users' access.
• Impersonate another person or misrepresent your affiliation with any entity.
• Use the App to distribute spam, malware, or other harmful content.

5. Subscription Tiers

Kindr offers the following subscription tiers:

• Free: limited access to core features with restrictions on the number of children and document uploads.
• Plus ($6.99/month): expanded access including more children, more document uploads, and calendar sync.
• Family ($9.99/month): full access for the whole family, including unlimited children, documents, family sharing, and priority support.

Prices are subject to change. We will provide reasonable notice of any price changes before they take effect. Continued use of the App after a price change constitutes acceptance of the new pricing.

6. Payment and Billing

Paid subscriptions are processed through the Apple App Store or Google Play Store. All billing, payment processing, and refunds are handled by the respective app store in accordance with their terms and policies. We do not directly process or store payment information.

Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your device's app store settings.

7. AI-Generated Content

Kindr uses artificial intelligence to extract events and information from uploaded documents. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. You acknowledge and agree that:

• AI-extracted events and information should be reviewed and verified by you before reliance.
• We are not responsible for any consequences arising from inaccurate AI-generated content.
• You are solely responsible for verifying the accuracy of all events and information in your calendar.

8. Document Uploads

You retain full ownership of all documents you upload to the App. By uploading documents, you grant us a limited licence to process, store, and analyse the content solely for the purpose of providing the service. We do not share the content of your documents with any third party other than our AI processing provider (Anthropic) for the purpose of event extraction. Uploaded documents are stored securely and are accessible only to you and authorised members of your family group.

9. Termination

• We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a manner that may cause harm to us or other users.
• You may delete your account at any time. Upon deletion, all your data will be permanently removed in accordance with our Privacy Policy.
• We reserve the right to discontinue the App or any feature at any time with reasonable notice.

10. Limitation of Liability

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• We are not liable for any missed events, incorrect AI parsing, or scheduling errors.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for any loss of data due to circumstances beyond our reasonable control.

11. Indemnification

You agree to indemnify and hold harmless 12 Tables Holdings, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
